I went to the Bronx Housing Court, located in Bronx, New York and had a Power of Attorney to speak on behalf of my fiance'. I was approached by someone working in the courtroom and told that I could not act as her power of attorney. At first I was told that I could not act as her power of attorney because she was present. When I explained that it is her wish for me to talk since the situation is to upsetting and she would be unable to express herself in a beneficial way I was told no. I explained that the power of attorney allowed me to speak at a conference in federal court and also in Bronx Small Claims Court. She told me that it could and would not be the case in that courtroom. She said that the only way I could speak is if I was an attorney. I told her that I was not receiving any payment to represent her and she still said I couldn't.

It is my understanding that a person can be represented by another person even if they are not an attorney. She is even willing to waive any of her rights, so she will be held to any decision that the court comes to, by me representing her.

Please advise me.Thanking you in advance.

Bronx housing court is not that bad... what was she there for? What are the details of the case?

If the clerk said it is not allowed in that courtroom then that is the judges rules, and NO ONE can change that...judges have total power over how their courtroom is administered.

Now some judges DO NOT even sit behind the bench..no kidding, everything is discussed in private with a court reporter.

So maybe the judge goes back in chambers and does it informally so he can hear her side in a more relaxed setting...courtrooms are scary!
