My eldest sister is the power of attorney for my mother. She placed my mother in a nursing home. My mother's health is now deteriating. She has bed sores and swollen ankles due to being forced to sit in a wheel chair all day. When she arrived in the home my mother was able to walk with a walker, she is now too weak to walk alone. She has been in this home for only 6 weeks. She placed her in an alzhiemers unit. My mother is of sound mind, she does NOT belong in this enviroment. I feel it is very damaging to her mental health. My mother wants to be moved to another nursing home which is closer to another daughter. A daughter who cared for her for years. The sister with power of attorney refuses. Can my mother revoke the current power of attorney? My other three sisters have not been allowed to see any legal documents concerning our mother. We feel helpless. How can we help our mother escape the grasp of a
cruel sibling?

My response:

You need to see a Family Law attorney to start the Petition process to obtain a "Conservatorship" of your mother. An order of Conservatorship "trumps" a Power of Attorney.

Power of attorney

Would it be possible for my mother to revoke my sister's power of attorney?
Or could she appoint an additonal person with the same power?

Yes, it is possible to cancel or revoke a power of attorney. Your attorney can advise you on this.

You should also consider posting this same question on the FAMILY LAW section of this freeadvice.com website where it will more likely be seen by someone experienced in this area.

I have posted in the family law forum but did not recieve a reply.
Now, my sister with the power of attorney has banned my sister, myself and any attorneys from the nursing home. Can she do this? Does power of attorney give her the right to deny me visiting my mother? We are trying to seek council but have not gotten any call backs yet. help......
