my husband is in jail on drug charges, we are common law. the problem is that his sister claims that she has power of attorney over his money. we have two children together and every document whether it is legal or not we have put each other down as husband and wife. he has stated in a letter that he has written to me from jail that he does not want his family touching his money and gave me specific instructions as to what to do with it. what i want to know is will the power of attorney hold up in a court of law because i was told that as long as we have children together it wont. this is all taking place in the state of texas.
