Agreement is governed by California Law.

http://www.powweb.com makes the claim that "your sites load quickly and are available at all times." on the page: http://powweb.com/PowWeb/Technology/Network
(In case they change it: http://www.sg-designs.net/public/powweb.jpg)

This is not true as various clusters suffered severe downtime lasting up to two days.

The TOS (http://powweb.com/PowWeb/Company/Policy/TOS) makes the claim of 99.9% uptime over their entire network at large, which may be accurate. However, is it still appropriate to advertise 100% uptime? This sounds like false advertising to me. The downtime has also affected many businesses who lost a lot of money.

Looking for input.

Thanks,

Josh

**A: you know for a fact that no company, even Microsoft, can guaranty 100% uptime. Get over it.

I know that perfectly well, and I'm not even involved in this myself. I had hosting to try for 30 days, which I've cancelled for a full refund (which although declared a full refund, does actually subtract $30 for the domain - outrageous in itself). I just am wondering if it's a fact 100% uptime doesn't exist, can you still ethically claim 100% uptime??

**A: Don't you know that there are 2 ways to spell the word. And there are 2 ways to spell the word because, like that and 'cause but never cuse.
