What is the name of your state? NJ
My employer took my health insurance premium out of my gross pay.
My W-2 form has my income listed as the gross pay and there is no indication of the health insurance deduction anywhere on the W-2.
Thus in filing my taxes, I owe and I've never owed and I'm pretty damn sure that I don't owe anything this year (I receive no income other than that, have no investments, own nothing, and just deal with my W-2 at tax time).
I also do not know if he had a sec 125 allowing him to do this (or can he just do a pre-tax deduction simply on his decision?).
How does this work for fed and NJ - my understanding is that for the fed pre-tax is OK, but NJ doesn't recognize it.
Any hlep would be appreciated as my employer is starting to refuse to do anything about it claiming it's "my problem if the numbers aren't right becasue that's what I paid you last year."

The amount you pay for health insurance may very well be income, so the W-2 is probably correct. Some businesses set up plans where the amount is taken out of the gross, but not all.

If its deducted post tax however, she can see if its possible for her to itemize her deductions and include the cost of the health insurance. It may not be of any benefit, but it wouldn't hurt to run the numbers.

Also....if your employer really did deduct it post tax, then your employer cost himself extra money in social security and medicare taxes, which your employer may not realize.

Op...just to clarify

Pre-tax means that the insurance premiums are deducted from the total reported in box 1 on your W2. Post-tax means that the insurance premiums are included in box 1.
