I was told that I did not have a job to come back to after maternity leave.....I submited a leave plan when I was 6 1/2 months pregnant. 2 months later I had to go on leave early because I was very sick. When my baby was delivered 1 month later he was very sick and in intensive care for ten days. My spoke to my supervisor about when I would be coming back to work and she told me leave plan had not been accepted and that I needed to come back immediately (no notice so that I could find qualified daycare for my special needs son). She told me I should just leave and collect unemployment. When I could not find care for my baby, they said they did not need me as they had hired someone 2 weeks before. They are not offering my cobra coverage, they did not pay my holidays and accrued time off. And they lied to DES, saying I left them (later they changed that).
They are a small company. Can they get away with this?
