I am posting this for a friend of mine. He and his wife were together for 8 1/2 years before they got married. After 4 months she left him for another man. A month later she and her hew BF left the state. they have been gone for 4 months. she is now pregnant and movving back with the bf. the bf told my friend that he(bf) isn't responsible for the baby and that my friend is because he and his wife are still married, and no divorce has been filed yet. he basically used it as a taunt and threw it in my friends face that hey will have a baby but my friend gets to foot the bill plus child support just because they are not yet divorced. IS THIS TRUE??? I know that a child born to a marraige is pressumed to be the husbands. but if she's been gon can he fight it??

He's got his work cut out for him. He needs to file for divorce right away. He needs a good attorney to help him with this. He will need to deny paternity immediatly, legally. He still may be on the hook, but he will have a much better chance if he does something about this NOW.

After reading through this forum on a regular basis, I was afraid of that. He was going to start the process but figured since he had no idea where she was. I told him there was probably a way to file w/o knowing exactly where she was. ie, news papers, etc.
with her coming back it definately is causing alot of upset, but now he can file and move on.

He still can file for the divorce NOW, and complete the action. The child support issue will not be determined until the child is born. Since he knows that the child is not his he must not do anything necessary to take care of the mother. Should he have doubts about who the father is he will need to take care of business until the child is born then get a DNA test. Good luck
