Pregnant Minor Florida

My son's girlfriend just found out that she is pregnant. She is 17 and they wanted to get married but couldn't get parental permission from her divorced parents so now she is pregnant. Last evening the mother hit this teen with a closed fist on the upper arm (which is still sore today) and had the father who lives nearby come and take her to his house. She didn't want to go to either home as the father can also be abusive. (The girl just found out today that she is pregnant confirmed at a doctor's office). She left her father's house this morning taking all her belongings with her and is now staying at a friend's house. Her father called her on my son's cell phone and left a message that they had a deadline to call him or he was "calling the law". She did call him but he did not answer and so she left a message that she is safe but that she is pregnant and will not meet with him until she feels safe. Now a deputy is calling my son's cell phone and requesting to speak to the girl. What do we do next? Is she allowed to stay with the friend or with us since she is now pregnant and 17? My son and her are planning on getting married this week or asap since apparently in Florida if you are 17 and pregnant you do not need parental permission. I do not want her to get taken back to her father's or placed in a temporary home as she is now carrying my grandchild and is more than welcome to stay in my home. My son is leaving for the Coast Guard in October, they have a substantial savings account together and even though they are young this is apparently very well premeditated and my husband and I will support them as much as we can from a legal standpoint, I just don't know what that is. HELP**************I am truly scared for this girl and my unborn grandchild. I have already filed a report with Dept. of Family and Children but who knows when that will help.

Age of majority in Florida is 18. She is still a minor and anybody harboring her or contributing to her delinquency could get into trouble.

From Florida statutes:

741.0405 When marriage license may be issued to persons under 18 years.--

(1) If either of the parties shall be under the age of 18 years but at least 16 years of age, the county court judge or clerk of the circuit court shall issue a license for the marriage of such party only if there is first presented and filed with him or her the written consent of the parents or guardian of such minor to such marriage, acknowledged before some officer authorized by law to take acknowledgments and administer oaths. However, the license shall be issued without parental consent when both parents of such minor are deceased at the time of making application or when such minor has been married previously.

(2) The county court judge of any county in the state may, in the exercise of his or her discretion, issue a license to marry to any male or female under the age of 18 years, upon application of both parties sworn under oath that they are the parents of a child.

(3) When the fact of pregnancy is verified by the written statement of a licensed physician, the county court judge of any county in the state may, in his or her discretion, issue a license to marry:

(a) To any male or female under the age of 18 years upon application of both parties sworn under oath that they are the expectant parents of a child; or

(b) To any female under the age of 18 years and male over the age of 18 years upon the female's application sworn under oath that she is an expectant parent.

(4) No license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in subsections (2) and (3).

Brilliant move on the kids' part. They couldn't get parental permission so they made a half-cracked choice to get pregnant? Good grief.

that is not necessarily abuse. Did it leave a bruise? And mom can call dad.

She didn't want to go to either home as the father can also be abusive.


So? She is a minor. She belongs in the care and custody of one of her parents. She does NOT get to dictate.

You better have the girl speak to the deputy. Or you and the friend and any one else hiding this child can be charged with a crime.

Tough. You have no rights to to this girl. She is a minor who should be with her parents and not knocked up as a teenager. .

Let me get this straight...Romeo and Juliet wanted to get married. You & your husband are perfectly OK with this, but HER parents aren't. So they decide to try to have a baby instead because they are under the impression that pregnancy would emancipate her and allow her to marry without parental permission. Am I right so far?

That certainly appears to be the case, however it also appears that there may be some domestic violence or potential domestic violence involved in both of her parent's homes.

The girl needs to at least talk to the police. The situation is going to escalate if she doesn't and it could get very unpleasant for everyone.

and even if you could prove she is being abused, she would probaly either be placed with a relative or foster care, not YOU. this isnt your child. stop trying to encourage her to live with you, before you get into trouble with the law, and get hit with a restraning order by her parents. shes not going anywhere untill shes 18, and theres nothing she, you or your son can do about it
