Pregnant Tenant

Hi All!

Quick question. My husband and I have been living in one of our own duplexes for the last year, while we look for our "dream" property. Two young women moved in to the attached unit, beginning of April. They are on month to month. This evening I saw the fiancee of one of the young women carrying a baby changing table and what looked like parts of a crib into the unit. I want to ask her if she is pregnant. Normally I wouldn't care if she is, as she is only staying six months, except for lead safety issues. She signed lead disclosures before she moved in. This unit has not been tested for lead-safety, which she was also told. Are there any legalities involved with asking her if she is pregnant? I know that seems a silly question - what's the harm in asking, right? - but RI is pretty hard on landlords so who knows what trouble I could be in for asking! Also, if she is, we would like to have her sign an additional form confirming that we have told her about lead issues and pregnant women. Any problem there?

Since there are no Rhode Island attorneys on these forums, and since we'd have to research the issue just like you would, and since you're a landlord, what does your Landlord/Tenant law book say on the issue presented? You know, that's the book you bought at your local book store . . .

If the duplexes were built prior to 1978, you should already have a signed lead based paint disclosure in the file along with the lease.

Thanks for the reply. We do have the signed documents, and my husband went over them with the tenants to make sure they understood what they were signing. Still, I feel very uneasy about this. God forbid something does go wrong with the pregnancy, I have no confidence that the disclosure papers would protect us.
