What is the name of your state?OHIO
I am a pregnant an unmarried. The father and I have had problems throughtout our relationship. We may not be together when the baby is born, I am not sure by listing him as the father on the birth cerificate and giving the baby his last name entitles him to what rights?? He has stated that he thinks he should have joint custody. Is this possible? I don't want to make a decision for my unborn child that I will regret later.

**A: it would not matter if you did not list his name on the birth certificate and listed the baby's surname as your maiden name. This boyfriend would still have legal parental rights as the bio dad.

By putting his name on the birth certificate and signing an acknowledgment of paternity (acknowledgment has to be signed in order for his name to be on the birth certificate) he is entitled to pay child support. Signing an acknowledgment at the time of the childs birth does not in itself grant him visitation or "joint custody" He will have to go to court to set up visitation. By the way the term "joint custody" does not mean 50/50 time share of the child it only means that you will both have the right to have imput in how the child should be raised.....what religion,school........Major life things... etc... don't get stressed, nothing can be done until after the child is born anyway..

He would not have rights until he went to court to establish his paternity through a DNA test, and then he would have rights to visitation and child support.......... This can take months.

She is obviously concerned about how visitation will be handled. Like most new moms the thought of handing over your tiny baby to anyone is a concern....I was just letting her know she has time.........she doesn't need anymore stress.. They are not married so his rights are earned through going to court.........
