What is the name of your state (only U.S. law)? Alabama
With a PreNup in place which states I will receive only $10,000 for each year of marriage (4 Years now) or married for 11 then it is null and void, question is can he kick me out of the home he owns solely in his name? He has given me until the 3rd of Sept. no children.

So I understand that Alabama is NOT a community property state, so this means he can give me a 30 day notice verbally or does it have to be done through the court? And also can he just trash my belongings in the house? Of course who is to say what is mine or his but he will trash my things if I'm not out by the 3rd of Sept. Then he told me to get the divorce lawyer since I want the divorce.

Look you know he wants you out, why prolong and make more nasty what already seems to be a very uncomfortable situation.

You should be out by the 30 days with all your stuff.

While I cannot disagree with the previous responses. Legally he cannot kick you out of the marital home. Only a judge can do so.

I'm confused here folks. If this is the marital home, can he just "kick her out"?

I thought only a judge can have her removed.

If a judge signed off on an eviction, then a judge DID order her out.
