Prescriptions erroneously paid by former Insurance Company

Hi,

I have medical coverage through my employer and changed my medical insurance companies effective 1/1/08. Both the old (Insurance Company A) and new (Insurance Company B) insurance companies use the same prescription card administered by a 3rd party prescription drug administrator. However, due to some apparent mix-up in the change process, prescription claims submitted in early 2008 using the card were still being charged against Insurance Company A instead of against Insurance Company B.

Recently, my former insurance company discovered the error and wrote me a letter requesting "reimbursement" for the amounts erroneously paid to the pharmacies in 2008 on the grounds that the "payments were made for ineligible expenses".

As I had no contractual relationship with Insurance Company A effective 1/1/08, am I liable for the payments they erroneously made to the pharmacies in 2008? Shouldn't they seek reimbursement directly from the pharmacies who, in turn, should seek reimbursement from Insurance Company B?

Any feedback would be much appreciated.

YOU should pay back the pharmacy and seek reimbursement from the NEW insurance company (by filing a claim). You *may* be able to do this in the reverse order (ie: file a claim first and then pay back the other insurance company). In any case, you need to be in touch with BOTH insurance companies about this.
