My brother and his wife are separating for an unknown period of time. There is a high likelihood that she may leave VA to move into her aunt's home in NC.

Is there any protective order or something similar my brother can file at a court to prevent her from leaving the state with the children while the details of the separation/marriage are worked out?

My brother's heart would be broken and so would my mother (the grandmother). Any advice would be greatly appreciated.

Isis1,

I appreciate the quick response.

At the courthouse what exactly would he be asking to file? A temporary restraining order? A protective custody order?

Thanks again.

Is there a good reason that DAD, as the LEGAL PARTY, can not post for himself?

All of this mess has transpired within the past hour. My brother is a good man but has not dealt with his wife's issue that stem from her deep-seated issues with her mother/father. He's still at work and works for the government so their internet is locked down.

As his brother and uncle to the children I'm simply trying to gather as much information as possible for him so I can educate him as to the best options for him and the children going forward.

Please direct DAD to this forum. He can post his issue here...IF HE WISHES.

It is not appropriate for anyone but Mom or DAD to post their CUSTODY issues on a public forum.

Well, I was trying to be kind but both of your posts were extremely useless and added nothing productive to the issue at hand; typical internet forum fodder that is all too common in our digital age.

I've found the information I needed and won't bother visiting these forums again. It's sad when a family member is discouraged from trying to help one another but I guess these are the times we live in.

Isis1, thanks again for your courteous response. Blue Meanie, enjoy playing forum police.

Well, it appears that OP told those seniors a thing or two.
