Hello & Thank you for taking the time to read my question.

I was recently let go and filed for unemployment. The original decision was not in my favor, which I couldn't understand why, so I filed an appeal. I received the appeal paperwork Monday and was completely SHOCKED! :eek:

The paperwork submitted by my previous employer is bogus. These items were not completed or signed by me, but yet there was my name in someone else’s handwriting! :mad:

Why would a company do this? How could a company legally do this? They submitted this to the Unemployment office as FACT.

What do I do? - I pulled out my 96' divorce papers, my mortgage papers, receipts, cancelled checks and my signature looks the same on every paper except the forgeries!

Who do I call? Who can I give this too? Oh GOD help - I can't believe this. These documents state that I resigned, no wonder the unemployment claim was denied.

I immediately called the unemployment office about this, they told me to bring it up during the appeal conference call. How do I show them that the signatures are bogus over the telephone?

I would be grateful for any advise - I haven't a clue what to do. :)

Look at your appeal documents. It should tell you were to mail or fax your rebuttal statement and any other documents you believe are relevant to your termination. Make sure if it states you need to send the exact same documents to the emeployer as well. Make sure you send it either return reciept or where they have to sign for the documents.

I thought I would post an update.

I called my family law attorney and emailed the documents over to him. It is quite event that someone else signed my name and he told me to request a postponement of the hearing and get to the Employment Lawyer ASAP.

The hearing is/was scheduled for next Tuesday and the quickest I could get in to see the attorney is Monday. So that is where I am at.

As I said to my family law attorney, this is more that just the unemployment claim. I feel violated, victimized and a half dozen other adjectives.

All of the unemployment information says you should be able to represent yourself - that "most people represent themselves" but you can have an attorney at your own expense. And expensive it will most definitely be - but what do you do when a LARGE Multi-million dollar company is willing to commit fraud. How on earth can you combat that in a legal arena without expertise in that area?.

I'm positively floored at the carefree attitude by the unemployment office that they would so willingly accept fraudulent materials - no questions asked. I am also shocked by the fact that the unemployment office wouldn't want to be more proactive on a claim of fraud when evidence is volunteered and am very curious as to what their course of action will be once the claim is resolved.

It is just incredible, I mean after all I guess they really didn't commit fraud to me they just used my name to commit fraud to the unemployment office. So how many others did this happen to? All employment issues with the company I worked for are handled solely out of the corporate office so I never heard of anything like this and it's not like I have or intend to call co-workers and tell them what I am going through.. It’s personal don't you think.

I don't believe I'm the first, but I sure as hell hope I'm the last - this is a horrible feeling and if it isn't a crime then it should be.
