I have filed a claim; therefore my attorney says since I have had previous injuries to my back & Jaw(TMJ) the insurance company/jurors will rip me apart saying I'am trying to get rich off of a rearended accident; but the truth of the matter is my pain is on the opposite side & I hurt all the time! My bills have accumulated well past $12,000 now I don't know weather to go to trial or settle for the fact I have had previous pain in those area of my bodily injuries. Insurance offered $16,000 but we ask for $50,000 should I settle or ask for $35,000. It was totally the other persons fault! I'am so worried I will end up in a wheel chair later in life; even though they can't find what is wrong with my back. Help me make a decision in this matter. Thanks

Hard to reply without knowing more details:
-how old are you
-are you working/lose time from work
-treatment, if any
-when was the prior injury? what treatment?
-how close are you to trial

If the insurance company made an offer of 16K, they must believe it is a real injury.
Whether you could get as much as 50K is hard to know. But your lawyer is right that the insurance company will emphasize your pre-existing injury.
