Notwithstanding other facts, would 5 PPO's, filed by the same person against 5 different people, in the past 6 years, have any merit (would the court take this into consideration) in deciding whether the most recent is frivilous? All of the PPO's have the same theme. I appreciate any input! Thank you!

And no, the court doesn't give a damn about what is obvious. The judge only cares about CYA.
If he grants it, no skin off his a$$. Just another average Joe Citizen sucked into the system. Legal gun control.
If he sticks to the letter of the law and looks at the big picture and doesn't grant it and then something happens. Bye, bye bench. The thought police are alive and well. 'What if?' is the theme of the 21st century.
These judges don't give a$$ cr@p about the Constitution, they only care about their pension and could care less about fairness or equal protection.

A perfect example of why the DV docket is clogged to the gills.

I'm sorry to all of the people that really have been victims of DV, but these laws must be changed. There must be some credible evidence of physical injury. As it stands now, if you have a grudge against someone, run to the courthouse, claim you and your children are in great danger. That you are afraid for your life and that the other person is going to kill or injure you if you don't get 'protection'. Exaggerate any contacts that occured into harrassment. Oh, and don't forget, 'He has GUNS and you are terrified of what he might do'. There you go. Now you can make real trouble for your grudge. Lure them, call them, vandalize their property (saying it was just an accident, of course), and my favorite, call their boss and try to get them in trouble. Have him arrested for perfectly legal conduct, for most of the people anyway. And all of it is state sponsored. If he reports this to the judge, don't worry, the judge doesn't care because he must have done something terrible to have had a final judgement entered (and he doesn't have time to review what it was because his docket is so backed up with other 'victims') and he's just trying to get revenge on you. So, go ahead, you're the victim, remember.

Our country was started on the premise that 'All People are created EQUAL.' Wasn't it Thomas Jefferson that wrote, 'If the government fails just one person, it is a failure of all the people.'
If the government has a reason to take a citizen's civil liberties it had better be a real, tangible and provable reason. The average person was oppressed by the English court and our forefathers saw and acted on this. Now, here we are, where a mere allegation, with no physical evidence, can get you thrown in jail.

P.S Don't be decieved that it won't happen to you. Now everyone that reads this will know what to say and do. Piece of cake. Go ahead, clog the court system with your frivilous allegations, NO ONE CARES!

You have a valid point - our courts are clogged with frivolous suits at all levels - but I have to disagree with your suggestion that "there must be some credible evidence of physical injury" in order for someone to obtain a PPO. If someone is being stalked or threatened, the first credible evidence of physical injury can be death. The whole idea of a PPO is to prevent violence from taking place, not prohibit contact after the fact.

A Piece of paper isn't going to stop a killer or a batterer no matter what it says.

People need to provide for their own protection and they can in many different ways, but they don't, because in most cases they aren't really afraid. They just want leverage. How long does it take PD to get to your house? Not fast enough to stop a determined killer.

What I see happening, here in this country, right now, is a gimick, that is being exploited by people, ex-friends, neighbors that have a grudge, by spouses who want control of the marital home and child custody and they're getting it.

This is a feel good law that won't stop the real killers and will only oppress the honest people.

Read Ms. Manners today. Here's a woman that wants to know if she should get a RO against her busybody 70 y/o neighbor!!!!

Is it any wonder we think and they tell us we need new courthouse's,
judge's, and government workers.

This is pitiful, that someone would actually seriously consider a RO for this, instead of getting a backbone, but this is the NEW american way, kinder, gentler. Call me an old fart and I'll beat you to the courthouse and get a restraining order on you,,,nan ne, nan ne, bo bo!! A bunch of freaking big babies! Get a SPINE!

Is this what the government secretly wants? Everybody will have a RO against everybody else, then no honest citizens will possess firearms that they are trying to CONTROL.

Don't be deceived!!
