I have recently found out that someone at the local Child support agency in Maryland has given out my personal information to my youngest son's father. I have 2 children from one man, which live with me and 1 child from another, who lives with his dad. Information concerning the amount of support I receive for the 2 and how much arrears, when and how much he paid recently in arrears. He mentioned this information about 3 weeks ago and said he is not able to divulge his source. All of this information is in court record because it was during a hearing. I did conctact the 2 childrens father and asked him if he gave this information out and he said no, because it is not his information to have. I then contacted the local Child support director and spoke with the assistant concerning this and informed them that I want to know why this information was given out to someone who has no connection with my 2 minor children. I was told that I would get a response within 48 hours from the Director because this information should not of been given to him for any reason. Then I find out the next day that someone in the department sent a wage attatchment with my name, address,ss#, phone #, and date of birth to a company I have never worked for before in another state. They never verfied if I worked there or was working there. I was also said an investigation would be done and that I would be contacted within 48 hours because that is not how things are to be done. It has now been three weeks, and I have yet to get that call. I have called again and left a message because I am now reaching the answering machine. My family says that I should seek legal advise because of the length of time I have given them and also because under the Federal Privacy Act my rights were violated by the agency. Is there something I can do? Any help or advise would be appreicated.

And how do you know that this is where the information came from?

All of this information is in court record because it was during a hearing.
And that makes it public information available for anyone with the cost of copying.

yes, you can learn about public information and the FOIA (freedom of information act) because you have no case.

I am going off the basis of the county clerk who would not allow me to even get copies of specific personal information from my own case file. They informed me that there has been current changes in the Act since 9/11, that infomation is not allowed to anyone just because. They have to show proper identification that they are part of the file, or have to be representing either party. Which he is not on the case nor representing the other party. Also the judge on the case informed my child's father that information pertaining to my 2 other children is irrevelant to him, because child support I receive from one case and arrears does not concern him since he is not on that order.
I also know that some of the information came from the office because when I called to ask some questions, it is in their computer system stating that this information was done thru the county in which the order is from, and that they had already starting their own investigation on who and why this information was given out and would get back to me in 48 hours concerning their own investigation.
I am concerned that my information was given out because of all of the identy theft there is out there. I work hard and pay my bills on time to maintain an excellent credit rating.
And no one in my family is an idiot, but knowing legally what you can and can not do concerning this issue was why they asked me to seek legal advise.

that's between you and the clerk.

Again, that is between you and the clerk. This has nothing to do with the FOIA.

the judge is incorrect.

that is not proof. That is your IDEA of what transpired.

anyone who told you your rights under FOIA were violated without any understanding of the law or the specific facts, not YOUR idea of the facts, IS an idiot.

Maybe you should read what is being asked before you answer. You were the one who said "who cares", when I said in my first statement that my personal information INCLUDING, ss#, d.o.b., etc was given out to a company. I CARE, and so should everyone else, because of identy theft. You should also do more research on The Privacy Act, and FOIA, they are two different things, and I never said my FOIA was voilated, again with the YOU SHOULD READ. And lastly people in glass house should not throw stones!

And maybe you should understand that a wage attachment is REQUIRED to have your DOB, SSN and other relevant information so that the correct employee can be garnished.

Let me see if I'm getting this right.
You don't have custody of all your children and you owe child support to the father of your son, who since you haven't paid is trying to determin your sources and amount of income and attach your income to pay the child support you have been avoiding.

What kind of a relationship did you have with the father if he didn't already have your SSN and doesn't he already know where you live if your son has any visitation with you? Why did you lose custody? Why don't you just tell him where you work so CSE can attach the child support you owe?

I do pay child support monthly and have not avoided it in anyway, and I do have visitation with my son nor am I complaining about child support. C.S. knows where I am working, but sent the information to someone else. I do not hid the fact of where I work from anyone, there is no reason to.
If you read the first post I did you will see what I am asking about. I am not looking to sue anyone, but to have who ever released this information be reprimanded since the assistant to the Director of D.S.S. said that this should not have happened. I just want to know where to go from here, since no one from the county's D.S.S. is responding back.
