Good Morning.
I contracted with a company to find a suitable lessee to lease my car. (I was never informed of who the lessee was until after she had possession of the car).
I have several issues. The company, Global Auto Escrow, is a Payment Guarentee service. I have notified GAE by telephone and mail that the lessee is in default of the contract and they are non-responsive. They don't return my calls and it's obvious I'm being avoided. They are suppose to find another lessee and make the payments on the car for up to 6 months until a "suitable" lessee is found. I am trying to get my car back now. The police can't help saying that it's a civil matter requiring a law suit. I am in the process of using a Repo person but it is taking longer than I expected. Apparently the car is being hidden on the lessee's property behind a locked gate. I was told by a friend that I need to file a "Claim and Delivery" with small claims. Is this true and how long does that take? What can I do? She had mentioned that she might move to Georgia. I sent her a demand letter to return the car (certified & return receipt), but I have reason to believe that she has no intentions of returning the vehicle. I'm trying to find the fastest - least expensive route to take.
