Private School Jurisdiction

Our daughter attended a party at a fellow student's house during Spring Break where she had 4 ounces of alcohol. She attends a private Christian School where the students sign a contract of conduct. She is also an athlete for Fall & Winter sports where team rules stipulate no alcohol. Upon return to school, the students involved were interogated by the school administration and immediately suspended for two weeks, lost all extra curricular privileges, and were not permitted to attend the senior trip (if seniors), athletes in sports were suspended for their remaining sports and the National Honor Society expelled them from thier organization.

The School contract states an infraction can lead to punishment up to expulsion, however this was not done and the above penalties were assessed. Our daughter was the lone Junior in the fray, She was suspended and banned from extracurricular activities, but was also banned for 1/2 of her Fall or Winter sports season. We met with school officials, wrote letters to the Board, met with them and other school officials to have her "sentence" reduced or changed to community service or other positive activity but to no avail.

Does the private school have any jurisdiction in this matter as it occured off school property, not during school, and not at a school related activity? We as parents had already dealth with the issue, yet the school "rules" were applied. Also, the seniors were eventually offered community service in lieu of banishment from going on the senior trip, but our daughter was not offered the same option (even though we immeidately requested this). Does the equal protection under the law apply here?

No one can answer your question without reviewing the specific 'contract of conduct'; however, I will say that they very likely do.

Does the equal protection under the law apply here?
No, this is a private matter, subject solely to civil laws. As such, there is no requirement for 'equality' in this respect.... or for 'fairness'.

I see that the private Christian School is doing an excellent job at teaching your daughter right from wrong.
