what are my rights as far as rent is conserned when moving in a rental in the middle of the month? Isnt the rent supposed to be prorated? i have a month to month lease and the landlord insited that i pay for a full months rent even though i moved in on 15 of jan. instead of prorating the rent. i gave her a deposit to hold the place on the third of the month which is the day i looked at the place. what are my rights? I live in the state of MO.

Ahhhhhh no lease, nothing in writing.......

Then you agreed to rent it as of the 3rd, because she could have rented it to someone else that day...

The rent is due on the 3rd, doesnt matter if you were slow to move in....as long as it was empty and available to move in when she handed you the keys....thats starts the rental period!

UNLESS you have it in writing that the rental period starts on the 15th

Now do you see the value of a written lease....you lost 2 weeks!

prorating rent

does the rent due date start when i gave the deposit or when i was given the keys to the place being rented?? because i gave a deposit on the 3rd but i didnt recieve the keys untill the 10 day of the month...and moved in on the 15 day of the month.
i live in mo.

Well i would argue that since she gave you the keys the apartment was NOT Fully available to you untill the 10th,If it was then why didnt she give you the keys on the 3rd? Thats her screw up, not yours!

So that is when the rental period starts, unless of course you had something in writing.

so in the end she loses a week and so do you...thats a little better.
