Aloha, Maybe I should state the case in a nutshell (!) ... Son (17) goes to a party at the beach, Lawyers son (17) and 2nd def. son are "looking for" each other, a scuffle ensues, btwn the last 2 parties with my son not involved. Lawyers sons car, is damaged by allegedly, my son and 2nd def son. Day following, Lawyer contacts me at sons school, alleging what had happened night before. I say I will investigate, at the same time, 2nd def. son is assaulting the Lawyers son! Now, 3 months later after I have invest. and found lots of versions of story but the main gist is that my son and Lawyers 2nd son are friends on football and wrestling teams and state to my son that they know hw is not involved but because Dad the Lawyer is involved they cant do anything...Soooooo now i am a def. along with wife and son in court for 50,000 dollars, The 2nd def son, wife, and father are also being sued. I am at present in arbitration, and trying to do it Pro Se, It realy is a hassle to no end but his basis to sue is that we are negligent in parenting, which he claims is the cause of his damages. No police reports were ever made, and this was a party that did not take place after curfew....any advice out there???? ALOHA>>>>

Honestly, this sounds like a frivolous case and you will likely prevail. Although your story was confusing, I think I got the gist of it. You are defending yourself against a claim of negligent parenting pro se. Are you sure you want to go up against an attorney? It does sound like the plaintiff father does not have evidence to back up his claim. His son has even acknowledged that your son was not involved? But you may want to consult with an attorney anyway. Yes, Nolo Press is a great guide. Just be prepared, respectful to judge and other side, and calm. You will be fine.

HEY !!! thanx! I REALLY appreciate the ans. it does seem friv. to me , the whole case, the lawyer dad and his attitude, you are so right about the being respectful in court, to the clerks or whoever , they WILL help if you are SINCERE...MUCH thanx for the positive vibe I and my family appreciate the time it took to at least give your input ....
