I was involved in a car accident in August 2004. The accident was obviously not my fault, as the person that hit me was driving on a suspended license, stole the vehicle they hit me with, and ran a stop sign. My insurance company had to cover all my costs (thank God for full coverage insurance) and right now the insurance company is in subrogation. In the great state of Indiana, the insurance companies love to wait until the statute is about to run before filing the lawsuit to recoup their money.

Now here's the dumb question: Will I be summoned to appear in court to testify if a lawsuit is filed??

It's possible. They'll call you in for a deposition first, which is less formal, so you'll have some warning. And you might do the deposition and then not have to go to court because they settled after that (that's what happened to me a while back).
