probate, not going do to it.... but need advice

What is the name of your state (only U.S. law)?
we live in minnesota, my mother in law passed in oct. her husband died in feb. so what he had passed to her. there is really no issue on going to probate with her house. as there would be thousands of dollars of work that needs to be done and she has a reverse mortgage on it to the tune of 138,000, it would maybe sell for 140,000, we are giving it back to the bank in order to avoid having to pay out of pocket to the attorney and realtor. there is a sister who hasn't been in the picture for 20 plus years, who wants half, we have already spent several thousands on clean-up, cremation and such, so she wouldn't get anything, she would owe us. but the deal is... is there is a van, that is registered to my mother-in-law's husband, deceased, and since both are dead. is it considered property to the estate? 1st our attorney said it wasn't, and we could sell it, then all of a sudden, its considered property, in a matter of days he has used up his retainer we paid him. so we are no longer going to retain him. not at 250.00 an hour, well actually 250.00 per 15 min. or less. but thats what we need to know, is the van considered part of the estate? or does the bank now or will own it once we give the keys back to them and let them handle the house. don't ever do a reverse mortgage. this is a nightmare. i'm just hoping the bank will take the keys as there is no person taking responsibility of the estate. any help would be appreciated, thank you
