probation violation after 67 mnths sentence

Hello, my father was arrested upon returning to the U.S. and was given a 67 months jail time in federal prison for returning.Upon being deported the first time he was given a 3 yrs probation, he stayed out of the country for only 10 months before returning and getting arrested by the immigration.his time will be up in april and last week he received a detainer stating that the US marshalls will be comming to get him and return him to Washington DC for the violation of probation hearing. The question is do you think they will waive the probation and give him his deportation order or if not how much time will he has to do out of the 3 yrs violation time. They will be moving him back to DC after his last 30 days is over.

I wish I could help you but I don't practice federal criminal law or immigration. However, it is apparent that the federales have it in for your father. So if they don't just deport him they will certainly give him the maximum time for the parol violation. You should consult with an attorney near you. You can find one at attorneypages.
