This situation is in Florida.
My sister's boyfriend has just been called in for violation of probation because he could not afford the probation fees. He works a minimum wage job 40hrs a week to support him, my sister and their baby. Unfortunately, he has back child support to pay because when the child was first born, he wanted nothing to do with the two of them. Now, he has decided to live up to his responsibilites. However, they take half of his paycheck for back support. It get's worse. Last night the baby was taken to the hospital with a high fever, he stayed up all night talking to my sister at the hospital (we have the phone bills to prove this) and when his probation officer came over the next day, he did not hear her knock because he was fast asleep. She says this is a lame excuse and submitted paper work for probation violation. She refuses to listen to their money problems and says she can not call back the paperwork because she has already submitted it. I understand that she listens to excuses every day but is this leagal? Is there nothing that can be done? What kind of paperwork does he need to file if he cannot pay these fees? He goes to court on Monday May 21. Will he be sent to jail at that time?
