what is the maximum amount of prison time you can do on a probation violation? i've heard different answers...my understanding was you could only be sent back for the difference between what you served and your maximum allowable sentence according to your scoresheet.
in my specific case my scoresheet graded out with a range of 101/2 - 171/2 months and i was handed a split sentence of 1 year and 1 day plus 28 years probation because the judge wanted to screw up the rest of my life. I served 311 days and received 54 days gain time. Isn't the max I can do on a violation the remaining seven and a half months? Once you've served the max prison time isn't probation eliminated? Help...i need answers.
