I am on probation for Domestic Violence, which did not include any terms of drug testing by either the court or my probation officer. My probation officer specifically stated that my probation was not to include substance abuse or testing for such. I am going through a divorce, my soon to be x has continually made false accusations of wine, women, and song. My regular Probation Officer was on vacation this past week, and the substitute Probation Officer called me in for drug testing. I own my own business and am very busy. I had until 5:00pm to complete the drug screen. I arrived 5 minutes late, and was denied the time to complete the drug test.
My question is if the terms of my probation specifically states that drug screening is not to be included, do they have the right to require me to submit to the drug test? And if so, what are the consequences for violating the terms of my probation? Can you please explain to me what the status of my case could be, and also what are the consequences of violating terms not actually included in my probation?
