sigh. I typed a big entry in here, but lost in browser problem.

anyway the short story is that I have problems with an ebay seller.

I won an auction for tickets which did not exist. I paid. seller said they would refund but were very slow and did not do so till forced by paypal dispute decided in my favor.

seller made false statements about me repeatedly in feedback (stating that I did not pay, when I did, that I did not contact them, when I did, etc)

seller also initiated an "unpaid item strike" against me - claiming that they should get credit for auction from ebay because I was non-paying - when I wasnt. I protested this and ebay decided in my favor.

I think seller is doing these things in retalitory fashion because I would not remove the neutral feedback I left about them.

I think this is harrassment. I would like to take court action against them. can I sue for my time?

also I searched their feedback and they have done this kind of thing multiple times to others. I have emails from 3 other people with similar stories.

seller makes mistake, lists item that they cant sell. buyer puts neg or neutral feedbak, seller retaliates with false statements in feedback about buyer. seller is slow in refunding payment.

1) can I do something by myself to get feedback removed- ebay will not remove feedback unless lawsuit - what would it take to initiate a small claims or libel case on my part-

2)If I have a number of other people with same stories, what can we do together? anything?

3) is there anything I can do to get reimbursement for the time spent dealing with this persons spurious complaints against me... which take my time up...

It's pretty tough to get these cases into court, and then you have to prove actual damages.

But...you still can have his Ebay privileges suspended if you can get others to add to your charges with their own similar experiences. If this person does a lot of biz on Ebay it can cost him much more. You have a place to respond to feedback, and to reply to negatives. You can get at least 3 negative shots at this idiot on the feedback forum. Choose your words wisely to make him look like the sorry jerk he is.

You're upset about this idiot now. In the long run its not worth it, heck not even in the short run, Its unfortunate that there are these idiots on ebay but the only way to really deal with them is thru feedback. Never give negative feedback unless it is justified, then lay it on. Never buy from anyone with feedback score <99%.
