problem with Brother's ex's ex

Ok here it goes. My Brother had been dating and eventually moved in with this woman. She had been previously married with two kids. The problem is her ex-husband is a little "off". He barged into the house one night threatning to kill my brother, has swerved at him on the road several times etc. I basically told my brother that as long as he was in the relationship there would be problems and by being a willing participant in the relationship he was just asking for problems. They went to court over it but nothing happened.

Fast forward a few years, he's recently broken up with the gal, but her ex's harrasment hasn't stopped. The last incident was this guy was actually running after my brother while he was driving.

To compound the situation my brother is also my employee. It's gotten to the point where I'm afraid to leave him alone on job sites for fear the ex will finally catch up with him. The ex seems to know the law pretty well, as so far he hasn't opened his mouth while my brother is working or in a work vehicle. He also doesn't seem to be a problem when there are other people around.

My question is what do I do? Being his employer is there anything I can do? Were and when is the ex breaking the law? Is a verbal threat worthy enough to justify a police report? Is giving him the middle finger breaking the law? Do i have to wait for the ex to actually physically contact my brother before something can be done?

I'm sorry if this seems a little silly on the surface, it is no silly to me. I am truly concerned for my brothers welfare and if you knew the ex, you'd be concerned too.
