What is the name of your state (only U.S. law)? Michigan
Ok, here is the story.
I sold a printer on Ebay to someone in California for $500. I took it to FedEx where I made sure it was insured before handing it over to them to pack it. I took issue with the way they packed it but the guy at FedEx just disregarded my concerns. I later found out that the printer was damaged in shipping.
The proper thing to do would have been to contact me or FedEx. Instead, the buyer threw away the original packaging and re-packed it, this time packing it properly. They then wrote a note explaining that the printer was obviously damaged in shipping and put it in the box on top of everything. I recieved this with no prior notice, my only explaination being the note in the box.
I contacted FedEx to make a claim. Meanwhile, the buyer contacted Pay Pal to make a claim.
Pay Pal refunded the buyer's money and then came after me for it. FedEx refused to pay on the claim because they were unable to inspect the package because the original packing was thrown away by the buyer.
I just got off the pone with Pay Pal and they said that they told the buyer to send it back to me. So either Pay Pal, FedEx or the Buyer is responsible here, I really don't believe I should be on the hook for $500.
There was a reason I was selling the printer, I needed the money. I am in no position to pay back this $500, so I certainly don't have the money to hire a lawyer. Even if I did I would feel petty going to court over $500.
What can I do?
