What is the name of your state? Idaho


We are planning to move out of state, father has sole legal & sole physical custody of daughter. I am SM. BM was unwilling to sign an agreement allowing us to move, so we had to file a petition with the court for permission. She said we are 'stupid' for involving the court and is not fighting the move.

Because of the motion we filed, she thinks we are suing her because that's what the generic summons said when she was served (we are pro se). She lives in Vegas but hired a lawyer in Idaho. Her default date for the modification to move out of state was July 5. The attorney filed a notice of appearance (and nothing else) on July 1.

Question: does the notice of appearance qualify as some type of answer to the complaint or can I go ahead and file the motions for default, etc??
