I am 19 years old and have a room mate who is 22. we had a few friends over this past weekend. we had a few drinks. somebody who was invited to the party but didn't show called us in for an MIP party. well the cops showed up and didn't search anywhere. they didn't look in the fridge, freezer, or anywhere for alcohol! nobody admitted to drinking. when they asked if we were, all that was said we were just chillin. we never admitted to anything. they breathylized me and i blew a .030. i didn't get an MIP, just charged with procuring and so did my room mate. 4 others got charged with MIP. everybody blew between a .03 and .04 except for 1 person. but like i said, they didn't take any alochol, didn't search for alcohol or anything like that. is it possible me and my room mate can get the procuring charges dropped since the cops have no evidence we were drinking in the house? they just assumed because of the breathylizer tests people were drinking in the house but never investigated to see if it was true or not. we did have a game of pong set up but we use water like we always have. none of us even drink beer, but like i said, the cops didn't even look in the cups to see if it was beer or water. any and all advice is greatly appreciated! we have a little over a month before our court date.
