Promotion discrimination

What is the name of your state? FL

Heres my situation. Large corporation 5K employees exist. I feel as though I have been unfairly discriminated against and not promoted as those around me have.

I have obtained 120% of sales goals
One of only 5 people out of 90 that hit Q3 and Q4 bonus
2 1/2 years experience (at this positon) -(2 yrs. manangement, 5 years total sales experience)

Those that are around me did not hit their goal nor do they have the experience that I have.

One kid (and I mean kid - twenty years of age or so) started 1 yr after me. Quit, went back to school, returned 6 months later and did not hit his sales goal, was promoted above me.

Management has not provided why I was not promoted. They simply state I did not meet criteria. For the past year management did not pull me aside and say "this is what you need to do to get promoted", and why would they with my sales track record?

I have and did the same jobs that my higher paid co workers ( I also had a higher quota last year)

Isn't required to show why I was not promoted? Would this fall into an Equal Pay Act guideline?

No, this has nothing to do with the Equal Pay Act. Nor is an employer required to provide career coaching, explain why you weren't promoted, or promote the best qualfied candidate. There's no law which makes it illegal to make a bad choice.

Nothing your employer has done is unlawful unless they failed to promote you BECAUSE of your age, race, religion, gender, handicap, veteran status, national origin, or pregnancy. (Plus one or two other things that sometimes are added to the list at the State level - marital status and/or sexual preference.)

Word of Caution!!!

Not everything such as years within a company justifies a promotion. There has to be a lot of other things consider to. When the other candidate left the company to go back to school, have you ever thought that maybe they went back to pick up a Masters or something in Business? That alone would be enough. Maybe the company looks at them and promoted them based on their potential for growth. Maybe your D.M. just wanted you to be a "lifer".

Plus, I take serious offense of you referring people younger than you as "kid". That term existed back in Junior High but has no meaning as it pertains to present times. Maybe you are a little guilty of jealousy and age discriminating against younger peers. Trust me, everything that young Managers have to do, has to be better than the senior individuals at the same level. Key Word = Potential. I am wondering if you would be willing to go back to school and pick up another degree in Business? Or maybe you think that your years are all so important? I actually commend your Corporation for their straightforward thinking. Just put your shoes in that person's. Where were you when you were twenty-something? What position did you have? Maybe you might realize that individual shouldered a lot of responsibilities as you currently have at a much younger age. What is your age anyways? Maybe, your corporation thinks you plateau as in your growth "potential". You do realize that the next step up from Store Managers is a D.M. or Area Trainer. The question I have is that, did you ever consider that these positions require flexi ability in schedule, maybe possibly relocation to a different region? Do you have kids or other responsibilities that set your schedule from day to day? Keep in mind that it is much easier for a twenty-something to walk away from a lot of set responsibilities probably because my age group probably doesn’t have a lot to deal with. Just rent, car payments, tuition re-imbursement, student loans are nothing that can tie my group down. Especially if you ask that applicant what degree he picked up while they went back to school, maybe they deserved it. Stop hating on younger peers.

He dropped out of college (he's literally between the ages of 19-21), went back, and is not finished. Trust me there no Masters Degree there, not even a Bachelors.

I'm only 27, but, I was a manager at health food retail chain for two years (right out of college).

All 90 employees work the same shift.

No, I am married and again work the same schedule as everyone in the office.

I don't hate younger peers, only when they are less qualified, don't hit sales goals, and then get promoted over me.:mad:

The key word stated by you was health food retail chain. That being said, I think I understand your anger towards not getting promoted. I used to be in that same field awhile back. It's mainly whose ass you can kiss. Corruption runs rampant there. Wish you the best of luck. Find a new job. Managers in this business get paid crap as compared to other industries. You actually hit a soft spot because I used to be a store manager in the health food retail chain. Word of advice, look elsewhere.

Actually I never said I am in that line of work now, I said I used to be. I was simply giving you part of my resume. I quickly learned that theres no money in retail. Maybe in CA there's more money with the cost of living but none the less. Two years later I left and found a higher paying job. The one I'm in now.

I am in software sales now.

You're exactly right! Posting on this just confirmed it for me. I'm bending over taking it up the aaaarrrsssseee by my employer and its now time to move on.

ps. If you are in CA buy a house, sit on it for 5 years, sell it and be a millionaire!
