indiana here, i go to small claims court in december, do i have the right to get what evidence the plaintiff has, so i can try to fet my defense ready? the plaintiff claims he has alot of evidence on me like recordeings, and signed documents, but they have either been forged or he has somehow copied my signature, the cases is really pretty silly to me but to him its abig deal, its all a matter of his feelings being hurt, and wants $3,000 dollars from me for emotional damage and for all court cost. i have e-mails from him currently saying how much he missed me and loves me, can i use this in court as my defense?

I do not think Small Claims Court awards any damages for emotional distress. You owe the money or you don't. It was a loan or a gift. Hurt feelings have no value.

Contact the court clerk and tell them that you want to subpoena claimed documents and records from the plaintiff. They should have a 'standard' form that you use.
