Proper Supervision / Visitation Denial

My roommate and her husband are recently separated and preparing for a divorce. Her husband is taking their 4yr old boy and 8yr old girl for the summer. While he is at work, he wants his new girlfriend's 16 year old son to supervise the children. My roommate is very uncomfortable with this situation. She has never met her husband's new girlfriend nor her son and has no clue as to whether the boy is responsible enough to watch her children. Plus she fears leaving her 8yr old girl alone with a 16yr old boy. I personally don't know any 16yr old boys that would give up their summer vacation to watch his mom's new boyfriend's children. I could understand if he was to watch them maybe 1 night a week or something, but not every day during the summer. I would question any 16 yr old's ability to provide the constant, and proper supervision those children need. Although my roommate and her future ex are not yet divorced... does she have any right to deny the summer visit under those conditions?

I amhoping there is a temporary custody order already in place for your friend to even be considering allowing this visitation. Unless she has temp custody, he has every right not to even return the children once they are in his possession. If she does not have temp custody established by the court, she is setting herself up for alot of heartache and financial strain.

Until there is a temporary custody order in place, signed by a judge. Both parents have as much right to access and possession of the children.

Now, if she does have a temp order set up already, if it does not specify that he gets summer visits. I would not do it. If your friend has any doubts at all about this 16 yr old, and being responsible enough to care for the children then your friend needs to protect her children.

If your friend has not already done so, she needs to consult with an atty.
