i live in virginia and my husband wants a separation and i don't. we bought a townhouse last year. his name is on the loan and he signed a trust of deed to me. does he have the right to put the property up for sale even if i don't want to? i like where i live and i don't want to move.

My response:

Absolutely ! He can put the home up for sale; but in order to finalize any sale, he'll need your signature on the Deed of Trust.

But, when it comes to legal separation or divorce, he doesn't need your permission. All he has to do is file, and eventually, it will be granted - - with or without your "approval".
