What is the name of your state (only U.S. law)? TX
In January of this year, my boyfriend at the time drank too much and took some type of drug which made him crazy. He showed up at my condo at 3am and wanted to come in. When I didn't let him in he was trying to kick the front door in, then he threw a big rock threw the glass and shattered it all. When he got in his truck he then drove to the back of my garage and rammed into it a couple of times. I called the police, but they showed up at least half hour later. Since the incident, I forgave my bf. He had been under a tremendous amount of stress because of everyhing falling in around him, including his work situation. He since moved to FL since he could not afford his apt. any longer, was in a financial mess and obviously emotionally overwhelmed. We had been together about 2 1/2 yrs. He had a place to stay in in FL that his mother bought for an investment and she was going to let him live there rent free. He is 46 yrs. old. Anyway since the incident I received a bill from my Homeowners Association. I was going to turn it in to my insurance company, but then they would try & contact him in FL, he didnt want that, said he would pay me for the damaged doors., I stopped the claim. I also DID NOT file criminal charges. When the cop asked me what I wanted to do, I was so tramatized I didnt know what to do and I didnt want him to be arrested. The cop decided to categorize this as a domestic disturbance. He had NEVER done anything violent or crazy since we had been together. Since he left he has sent me $400, but I owe another $586 for the damaged doors. I just recently broke up with him and feel he is not going to make any effort to send me anymore money. He has claimed all along he has not been able to find steady work in FL and I understand unemployment is horrible since I have had trouble finding work here in TX. My question is can I sue him for the difference? How long after the incident to I have to sue someone? Will it be difficult since he is living in another state? If you answer please let me know if you are a legal professional. Thanks for your help.
