I live in a duplex and the other tenant and I share the backyard. I have a dog which resides on the property. The property is surrounded by a 6 foot chain link fence. The gates to the property are all locked with a padlock. There are only two people with a key, the other tenant and myself. My dog was hit by a car while I was at work and the other tenant was home that day. The tenant stated that they opened the gate that day to take out the trash but the dog did not get out. Approximately two hours later, neighbors found the dog running around in the street and brought her home. The tenant opened the gate to let her back in the yard, however, did not close the gate behind him and the dog escaped again. The tenant made no attempt to retreive the dog, call the owners (me), or call the humane society/police department. He further stated to the neighbors that he did know the owners name nor the dogs name. Yet we have lived next to eachother for 9 years and they have petsit while I was on vacation on numerous occasions. His comment to the neighbors was "I don't care, it's not my dog". What can I do to recover the thousands of dollars of property damage caused by their negligence?

Are you sure that all to this?

I think you are hiding something, because if it was true what happened you would not be here you would have already hired a lawyer to get all the eye witnesses statemets on the record, and have already sued the bastarrd!

I dislike dogs very much, but i could never harm one...id rather punch out the owner, for the dog constantly barking and stepping in dog krap and ruining my carpet...

So there must be something else going on............

I do not have an eye witness for the first instance of letting the dog out. Can I still sue?
