There is a vacant lot neighboring my home. There is a large tree growing onto my property and under the foundation of my house. There are already cracks in the foundation due to this tree's roots. The owner of the lot lives out of state. I have tried to work with the owner to no avail. If I take actions to rid of the tree, can I put a lien on the neighbor's property for the cost of removal? Thank you in advance for all responses.

The part of the tree on your side of the property line is yours to do with as you please. Rent a backhoe and root-prune the tree. If it dies, tough for the neighbor. Since the roots on your property belong to you, you can't charge the neighbor for the root pruning. Don't go onto neighbor's proeprty while you're cutting the roots.
