I had a verbal agreement with my neighbor to put up a block wall between us. I fronted the money and when it came time to pay he started coming up with excuses. Its been 8 months since his last broken agreement so its my understanding that the juristrictions are still in place?

Well today he tried to put up a gate bolted into the wall but legally he cant touch the wall as its legally all mine. It sits on my side of the property line and he never paid a penney for any of it. I had a land survey done before placing the wall. The previous wall was in the same spot so we figured we leave it in the same place for aesthics.

What are my rights on enforceing him to pay for "his" half? I understand I have to take him to small claims but I would like to know if its worth it or not.

Verbal agreement ? what verbal agreement likely would be his reply. Send him a registered return reciept letter tell him Since the wall is on your side of the property and that you paid for it , that he is not to alter , change , add any thing to it or you will sue him for damaging your property. keep a copy with your reciept from post office.

Yes, I figured out what he was doing, only too late. He basically was stalling to get past the time limits for me to sue. But still I have my daughter as witness that he came over to my house last Feb to say he would be refiancing his house this summer and could pay then. All in all since the wall was built, its been about 3 years. I know, I know, I shouldnt have waited so long but I have had allot of other things going on where this was a lower priority. :(

I guess if I take him to court he can say he didnt agree and stuff or whatever and I would get who knows what kind of decision. My other neighbor that is on the back side of my property went in haf'ers with me and seemed like she would be a problem as we had to draw up a written contract in case her plants were damaged and the pricing etc. but she was the good one and paid within a 2 week period after completion.

But since I have the property line survey and all receipts I could legally tear down the wall and be an arse if I wanted to out of spite? We built the wall an extra 15 feet to end at the back of his house so he could put up a gate. So I was thinking that I could tell him that he will have to pay one way or another. If I tear down that extra 15 feet he will have to put something up as he has a dog or he can have a very nice block wall and pay what he agreed to.

I'd rather get him to pay for his 50% of the wall verses just not having him bolt anything into the wall.
