I have lived in my home over 11 years. The property is bordered by a hedge and fence. A new property owner next door has found that the property is actually 4 feet into my property and is demanding we remove the fence and hedge. The line as we knew it was there over 30 years and we have had exclusive use of the property for the last year. Can we keep our property - it affects our childrens play area and a portion of our driveway our front yard hedge and backyard fence. Also a large tree is located in the neighbors yard and 1/2 of the tree hangs over into our yard and we have a hammock hanging on it. The neighbor demands we remove it because the base of the tree is in his yard - the hammock and chain are on our property. hey, we rake the leaves! Help us poor souls here in Minnesota!

You'll have to sue N to quiet title to the strip on land on your side of the hedge. You need to do this quickly, as N could just bulldoze the hedge tomorrow. A real estate attorney will be best able to advise you regarding the viability of your suit.

You can leave the hammock where it is. Any portion of the tree that hangs over your property line belongs to YOU. The only way N can disturb your hammock is if he can cut off the branch it's hanging on without crossing his body/hand/saw over the property line. If he crosses the line in any way, you get to sue him for illegal damage to trees & collect triple damages AND attorney fees. Point this out to him -- that makes his actions willful & wanton.

How do I find the statute that proves to my local police department that I can leave my hammock up - I am getting grief? In the meantime - we have a restraining order against N and are seeking out a qualified attorney.
