I live in CA. My origional rental agreement stated that I would pay 1st maonths rent (425) and a $500 sec. deposit. We moved in 11-1-97 after paying these fees. On 3-1-99, I payed my regular rent, and because I had extra money I payed for 2 months advance rent (so noted on my check.

Since then the property manager has refused to note the advance dates on my receipts. She first said that there was no record of hers or the owners that I made such a payment. Then, later said that I paid no deposit. Now she states that my $900 check was a deposit and wants me to sign an Esposto (sp) to that effect. I refuse, and I have the records to prove my case.

What do I do? I fear retribution.

What is the problem?
Your cancelled checks are your receipts and evidence of payments.
Send a letter confirming your correct accounting records backed up by copies of the cancelled checks.
If she does not correct the problem, advise her that you will be filing a complaint with the State real estate licensing office.

Who endorsed the check? was it the property manager? or Some little hottie in the office?

I think someone might have taken the money, credited to another account such as the payroll account and wrote a check out for the same amount.
It could have been listed as a bonus,or commission, the accountant would never know.

It would show up as deposited, but only the management company would know which account it was deposited in.

That would be my logical guess.
