Idaho- We recently had an annual election meeting and I would like to know if it is legal. We have 177 property owners and only 60 votes were cast. (Does this constitute a quorum or is majority of those present acceptable?) Additionally when the proxy votes went out the nominees were not nominated yet. The absentee votes come back with "Board Member Preference" on them allowing the board members to have approximately half of the total votes. Does this constitute an invalid vote?

That would depend on your bylaws...

If quorum was not met, or the election was otherwise invalid, then the old board remains the board.

A board can stay in power for years if not enough owners vote.

A quorum is often 50% plus one, but your bylaws will specify quorum for your association.

The board can have proxies.

Should you wish to defeat the board, then you have to get an owners list and do your own proxies. And of course you will have to know your bylaws and state law.

There may be other requirements in Idaho law.
