Property removed dumpsters - left not alternative

Hello That title should say, left NO alternative. Sorry, I can't see where to edit the title.

We rent at community with about 50, single story, ranch style units. There is an on site manager and the property is owned by a larger company. Every resident received the following notice September 2, 2011:

Dear Valued Resident,

We are sorry to inform you that we are in the process of switching waste removal companies, and that the dumpsters that are presently on site will be removed sometime between Friday 9/2 and Monday 9/5. There will be a gap between this and the arrival of the new dumpsters, of a currently undetermined period of time. XXX Mgmt. requests that you do not place trash in the dumpster areas, or on your patio during this time, due to possible health concerns. There is a trash deposit facility located at #### ### Rd. (local WalMart address!!), this is the nearest site where garbage can be taken.

We apologize for the inconvenience and would greatly appreciate your cooperation in this matter. Please call the rental office with any questions or concerns at 555-555-5555.

According to our lease agreement, we are to be provided with trash service and we pay a monthly fee for this.

What can I or should I do about this?!? I am seriously dumfounded that they have left us, going on a week now, with no dumpsters to place our trash in and had the nerve to actually tell us to take it to WalMart and put it in their dumpsters! Not only is that illegal, but I am not putting trash in my car and driving it (it isn't close) anywhere. Not to mention, there are a LOT of elderly people living here that don't drive at all.

We can't seem to find a corporate phone number, the phone number the on site office manager gave me to *her* manager got me nowhere. She literally told me they were 'doing the best' they can do and there is nothing I can do about it. She then refused to give me HER managers name and phone number, telling me she will provide it ''tomorrow''. I'm on the phone now, I want it now. Then she hung up.

Needless to say, several tenants have placed trash in the dumpster areas (that are dumpster free) and we're currently putting ours on our patio, like they advised us all not to do. One resident left a note on the office door stating that THEY can drive her trash to the ''facility'' if that's what they want done with it, as she pays her rent which includes a trash fee monthly. She left her trash sitting at the office door.

Any advice or help is appreciated greatly.What is the name of your state (only U.S. law)?

It's been more than 3 days. Thought that was clear in my post.

I have a problem with that; everyone that lives here does. I don't know why that seems unreasonable to you? We pay rent (not cheap by the way) and fees for services that are not being provided. We're not talking a day or two here. That I could understand. A week? Two weeks? No way. Ridiculous.

I don't know about you and how you live, but I don't leave trash sitting around for a week (or longer), and I certainly don't haul it in my car to the local WalMart illegally.

I like the idea of the tenant that put their trash on the office doorstep. I suspect if everybody did that the landlord would speed up the delivery of the new dumpsters.

If trash removal is part of the existing lease, than it is managements responsibility to remove said trash.

I too would leave my trash at the management office.

I am of similar ilk personally. The management company is in the wrong at some point. A couple of days? Fine. More than a week? Seems like a breach to me.

Sadly, littering is not the legal way to right the wrong.

MITIGATION is the key. Call and tell the management company they have one day to get trash there or you will hire a bin yourself. Then, have everyone split the cost of the bin and reduce the amount paid to the HOA next month.

I am not sure that placing trash in the complex trash disposal zone is littering.

I think the landlord placing the inevitable sanitary consequences of not not having proper refuse haulage containers on the residents is more likely a criminal or health law problem.

Also, I would have to be really, REALLY tight with my fellow renters to take on the liable personally for renting a dumpster, somehtign which costs scores, if not hundreds of dollars for a single tip, excluding the deposit.
