my brother and his wife have filed for a divorce last week. My 84 yr old father owns a boat and portable awning which he let my son keep at his residence. my father wants his boat and carport returned since my brother is not living at residence. wife had her attorney stipulate that my brother cannot retrieve boat/awning and that my 84 yr old disabled fahter has to "come get it" hinmself if he wants it back and on her stated time and day which was mid-week and allowing 15 minutes only! is this legal? does my father have legal entitlement to retrieve his own property with whatever means he has available and when he can arrange to move it. he wants to inspect the boat for damages and safety issues before hauling it back to his home in another city. is there any legal counter action that will grant him this right? the home where the boat is solely in my brother's name as it was his prior to the marraige.

Have a police officer met you at the resident and take all the time allowed by him. He will let you have your property on the spot. It's his JOB. If you are not allowed get a police report and sue.
