I am from a community property state, and am in the process of accessing the discovery on our debts and assets, my husband is responsible for getting all the necessary paperwork together. Since my lawyer asked specifically for bills owed, credit card, bank account debts UNTIL the court date, my soon to be ex. has witheld 1 vital cc and 1 bank account in his name. He does not know I have knowledge of these accounts, and failed to list them in the offical legal
inquirey.

My question is if this will have any impact on the Judges, or jury's decision when the final community property will be divided. Is his failure to list these very important documents considered a contemp of court, or failure to disclose? Are there any repremandatory actions we can apply for his concealing these assets, and debts? If these
accounts are made to the court, I am sure we can get him for squandering community funds. Yes he has a mistress.
My understanding since Tex. is a community property state, I am still half liable for his bills he accumilates up until the final divorce decree.

Also my lawyer is saying we are going to try and get more than 50/50 since he is going to argue that since he was the one who decided to divorce, there is possiablity we can go with lost marital funds and recover some of lost money through arguing, had he not had a mistress, I would still be be entitaled to half his earnings. Also I have police documents for physical abuse, and will be filing on adultry, mental and physical abuse. I was wondering if what the chances are this could happen. My lawyer is wanting to recover the lost funds through community property, and spousal support.

Also he is recording all my phone calls to him, and intises me to get angry with him. However his language is much more antagonizing than mine. Will this hurt or help my case?
As I see it, if the Judge/Jury hears these recordings, they will favor me.
