Surveyors Markers
my neighbor had his land surveyed when he bought the house between us for an Airbnb. My house has been here since 1956 and Ai fought it from the original owner in 2009. My neighbor needed to build a drench so he took down my chain link fence about 30 ft and graded/bulldozed 3/4 of my land when I told him not to cut the ridge. Anyways I have a lawyer , he did 1000.00 worth if danagevro duvert the water coming uphill . The stakes that the surveyor put up at the back of his property are 7 inches from the fence. Is that my land the 8 inches thats not fenced in? It goes up the fence its 4 in the middle. Is that mine too? He basically just encroached in my property vandalized , diverted flow of water, got away with it . Police wouldnt do anything . Codes wouldnt either . What do I do. ? Push the fence back, have an order not to build in that land. I bought my house before he bought his main house , than Airbnb , hes very greedy and doesnt care about ordinances or neighbors, just wants to make that money. Im in Nashville, TN

What do you do? Talk to the attorney you already hired. Absent a friendly solution and action from the government authority, it's likely going to take litigation.

He is just waiting for the answer in regards to the money he owes fir the damage he did. Then he said I get a 25%% discount for another attorney to handle the proceedings It wasn’t just my neighbor, his wife, and friend and not one feels they have done wrong. The city doesn’t care. I went all the way up to the new mayor of Nashville, my new district councilwoman, itscall hush hush.? They are labeled as Super hosts if only the renters from them knew what they did to my property. I feel I have the right to sue the city for not protecting me when I was in distress and the seargeant ofv16th district asked if I told him not to tresspass ! How could InifvI wasn’t here or asleep. I did message him not to cutbthe ridge down and he said if he needed to grade my land he would message which he didn’t . If I go to court it’s just not gonna be for the 1000 to fix it, he and his wife/ friend alll Comitte a class C violation Chief of Police in Msshville, TN didn’t care ,, Codes told me to
Quit whining and complaining and stand in line with the rest of them. I don’t think aftervsge treated me that way she would wanna hearvfrom me.

Do i just leave the fence thevwatbits is or do you think he will try to get easement rights onit? The kicker he’s a landscaper so he knows the rules instead of a drench why not a French drain. ? My neighbor is a bully and must know someone important because nothing is done about any of the complaints.?his StRRAurbnb is rented out ever night, it’s supposed to be owner occupied but they live in thier firstbhouse beside it
Thanks for the reply no never had deal . With neighbors like that since I lived in high rises.
Do I spend thousands on a attorney or just let him do what he wants. Am I allowed to put up signs in my yard if how bad a host hebis. To run over a senior citizen to get what he needed . That’s ok. He’ll get the same thing when time comes 10x worse. Have a good day.

Boxstarr, you were provided with some options in your first thread and again in your second thread. There was no reason to start this third thread - and on this forum we prefer that all questions on the same legal matter be kept together.

I suggest (again) that you have your own property survey done (or order a copy of the neighbor's survey from his surveyor) and figure out the damage to your property and sue.

You mentioned in your first thread the idea of moving. That is an option as well.

First of all I never mentioned surveyor sticks because he did t put them up until a week ago. How do you find the surveyor who did it. The municipalities don’t know because I called. I just took care of it with AirBnb. I’m sure you don’t have one beside you or you wouldn’t be trying to find answers since you city want help. #KARmA

I’ll never ask a question again. The lawyers on here are just as crooked like the ones her I’m sure , I had one suspended by treating 5 clients wrong mevone and the SCOTN [deleted ].
Maybe it looked the same but nonfir mebdibcevz not a specialist. BTW if you were having a heartattack
And no one there to save you but me I would come to the rescue and not write a harsh reply like that. After I saved you I would never tell you to stop smoking or eat bad foods you get my drift.

I am sorry if we cannot come up with a magic solution to your neighbor problem. I think you are at the point where you need to sue for damages. Because you have an attorney already, I suggest you rely on his advice and direction.

Yeah it is an odd lost like I’m getting chastised trying to do the right thing. Also, for the moderator to say that I have to very I’ll parents I’m dealing with and it’s very hard when your single/?a brain injured brother to find solution. I’m shocked I’m even alive. What you said could of been more sensitive than garage. I would never treat you like that in my profession. No the two other threads are not like this one. That’s ok I see how most people think she can read between the lines. Remember you might be at my beckon call 45k✈✈in the air.

Again, I am not quite understanding your posts. The members of this forum have tried to assist you but your situation seems to be one that requires personal attention from an attorney in your area - which is probably why you hired one.

I assume your attorney has visited your property and has seen the damage your neighbor has done to it. Diverting water flow, moving your fence, grading your land - all of this can be compensable damage.

If you get your own survey, you can show a court how the neighbor has encroached on your land. Get estimates for repairs to show the court.

In the meantime, if you want to post "No Trespassing" signs on your property, you can do that. I definitely do NOT recommend you post any signs that are critical of your neighbor and his Airbnb. You do not want to get sued, and a sign like that could easily result in a lawsuit filed against you.

Please rely on your attorney. That is why you hired him.
