Please help me. Here is my situation. My wife and I have been separated for 3 years. recently, I got back from the airforce and started with the divorce proceedings. She got very upset. In that time, She got me arrested for assault on a female, and when she got me arrested, she took my car. When I got out of jail, she left her car beside my house. My car was paid only by myself, my name is the only name on the title, I purchased it after we had been separated for almost 3 years. My car is in much better shape than her car, which I think is why she took it. Her car doesnt run well, inst insure, and doesnt have valid plates. On May 30th, I went to court for a protective order against me. My wife asked for possesion and use of my car. The judge gave her use and possesion until June 30th. The judge did not say anything about making sure the cars are in working order. Now... today, I received a letter from my wifes attorney stating that once I get her car insured, with valid tags on it, and running well, That I could contact her about switching the cars on June 30th. I dont want to insure a car or pay taxes on a car that I wont ever use again.
Do I have to Insure and register her car before she will give me my car back?
In a related matter, I spoke with her attorney just a few minutes ago, and she told me that I would "have to deal with the condition of my car" when it does get returned to me. I hae a feeling that my wife will damage my car out of spite and then give it back to me.
Can she do this?
Would she be financially responsable for any damage to the car?
When my car was first missing, I reported it stolen. When the police found it at her boyfriends house, they did note the condidtion of the car, so I have proof of the condidtion on the date she took possesion of it.
Please help me!!!!
