My mother has a piece of china in her home that my aunt claims is hers. My mom assumed ownership of her parents home over 40 years ago when they passed away (and subsequently assumed the mortgage and paid off the house). Now, after 40 years her younger sister (who moved out 40 years ago when she was married) claims that a piece of china in the house is hers. My mom claims it was given to her mother (and it has resided in the house ever since), my aunt claims it was given to her and she wants it.

Unfortunately, neither will give on this issue (and the "giver" of the china has long since passed away).

If neither can produce any evidence (besides their own accounts of the china's origin), does my aunt have any legal claims to the property or is posession "9/10ths" of the law (since it has been in my mom's house for 40 years).

I don't think this will ever elevate to a legal issue, but am curious as to the rights of those involved.

Can someone point me in the right direction?

when my mom passed away in november i became owner of everything, literally. i would assume it's whoever kept and paid for the house. if the other party wanted the china so bad she would've gotten it a long time ago.
