Hi all, I'm in a bit of a sticky situation. I am living with my mom and brother in a condo. Brother is 21 and I am 27. I work two jobs year round (three total), and am in school full time towards a masters. I pay half of all living expenses and bills. Brother is unemployed, scraping along in school, and is being supported by Mom.
Mom has been a stage 4 breast cancer patient for the past three years and I am her health care POA. My uncle is her POA. I dont think a court would find her to be incompetent-she is still working and is for the most part independent. However I see the day coming where that changes.
My brother is not an evil person, but he is stupid. His girlfriend has threatened my family and has called my mother online the c**nt with cancer. Mom had both of us on her bank account, but my brother was funneling money out of it last year to the tune of over $500.00. I work at the bank so I figured it out. He has wrecked the car my mom gave him 3 times and does not pay his car insurance. He also is unemployed and has been for 10 months.
Mom always bails him out and makes excuses for him, blaming his ADD. Nothing he does is wrong, even when he stole from her.
I am getting ready to move within the year across the country with my long time boyfriend for his work within a year. I am uneasy about leaving my mom and brother here alone. What are the legal steps I need to take to make sure she is protected? I've already come up with making sure my uncle is on her bank account, and getting a restraining order against the girlfriend. Any other ideas?
